The DomainSkate software is the monitoring system for our clients' online problems. Once the problem is identified there are a number of options for the customer.
- First, the customer can contact the registrant of the domain name. The purpose of this contact is to see if the registrant will transfer the domain name to the customer/trademark holder so that there is no escalation of activities and costs are kept at a minimum.
- Second, the customer can send the registrant a Cease & Desist letter notifying the registrant that their use of the domain name is a violation of their rights and putting them on notice that this is a problem. Further, the customer can request that the registrant transfer the domain name.
- There are other legal and administrative options that can be pursued but those should be discussed with a member of the DomainSkate team as they can be complicated.
There are a few reasons that there may not be WHOIS information listed for a specific domain name. First, it may be that the registry (if it is a small country registry or a private registry) does not publish its WHOIS Information. Second, under the new European Union privacy rules, some registry providers have decided not to publish WHOIS information out of concern that this type of publication could lead to fines under the new privacy rules - also known as the General Data Protection Regulation or “GDPR” as it is called.
NOTE: Even if there is no listed WHOIS information for a specific domain name it is still possible to contact the registrant via the registry provider. Thus, for example, if a domain name is registered with GoDaddy but there is no listed information for it, by contacting GoDaddy communications can be made/sent to facilitate the necessary correspondence.
